For too long, the American people have stood by while bureaucrats in the executive branch have claimed the power to legislate. We follow their illegitimate and void dictates as if they were law and have suffered greatly. However, two court cases have been pushed by bureaucratic legislation rewriting.
While I’m glad to see the outcomes of these cases, I need to warn you this is not the end of bureaucratic tyranny in America.
The first case deals with Title IX, the attempt to use federal bribery to manipulate schools. Under Title IX, schools are prohibited from discriminating based on sex or risk looking for access to federal funds.
The Biden administration attempted to rewrite Title IX by redefining sex to include “gender identity” and sexual orientation. A District Court judge in Kentucky has issued an injunction against this rule change until the case is decided in court.
The second case involves the bump stock ban. Here, the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) attempted to rewrite the National Firearm Act to redefine the term machine gun to include bump stocks. In this case, the Supreme Court said that was beyond the ATF’s statutory authority.
We should enjoy the wins but not lower our guard. Those who want to undo what these courts have done are already doing so and imposing a violation of the Constitution through legislation rather than regulation.
